1. Introduction
Welcome to The Safer Bath Company (All Access Adaptations, LLC). These Terms and Conditions ("Terms") govern your use of our website www.saferbath.com ("Site") and the services we offer, including bathtub conversions, installations, and related consultations ("Services"). By accessing or using our Site or Services, you agree to these Terms. If you do not agree, please do not use our Site or Services.

2. Definitions

• "Client", "you" or "your" refers to any individual or entity using our Site or Services.

• "Company", "we", "us", or "our" refers to All Access Adaptations, LLC, DBA The Safer Bath Company.

• 3. Services and Quotes
  3.1 Consultation & Quote: Clients may request a free consultation and written quote via the Site or by contacting us directly. Quotes are valid for 30 days unless otherwise noted.
  3.2 Scope of Work: The detailed scope of work, pricing, materials, and schedule will be included in the quote or service agreement. Any changes must be documented in writing and may incur additional charges.

• 4. Client Responsibilities
  4.1 Access & Site Conditions: You must ensure clear access to the work area, safe site conditions, and obtain any required permits before work begins.
  4.2 Information Accuracy: You warrant that all information provided (e.g., home ownership status, site measurements, photos) is accurate and complete.

• 5. Payment Terms
  5.1 Deposit & Payment Schedule: A deposit may be required to secure services. Final payment is due upon completion of work, prior to cleanup.
  5.2 Late Payments: Any overdue payments may incur interest at 10% per month or the maximum rate allowed by law.
  5.3 Payment Methods: We accept cash, personal check, credit and debit cards. All credit card transactions are processed securely via Wix Payments or via a Square card reader through the Square app.  All credit or debit card payments will be charged a 3% fee of the total due amount and added to the final total due.

• 6. Cancellations & Rescheduling
  6.1 Client Cancellation: To cancel or reschedule, provide at least 48 hours’ notice. Late cancellations may result in a cancellation fee of 10%.
  6.2 Company Cancellation: We reserve the right to cancel or reschedule due to inclement weather, safety concerns, or unforeseen circumstances. We will notify you promptly and work to reschedule at your convenience.

• 7. Warranty & Limitation of Liability
  7.1 Warranty: For bath to shower conversion, we provide a limited warranty on labor for 5 years for personal use in owner occupied homes and 1 year for tenant occupied or commercial homes or units, excluding normal wear and tear. Manufacturer warranties apply to materials.
  7.2 Disclaimer: EXCEPT AS EXPRESSLY PROVIDED, SERVICES AND MATERIALS ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.
  7.3 Limitation of Liability: Our liability is limited to the total amount paid by you for the Services giving rise to a claim. We are not liable for indirect, incidental, or consequential damages to the fullest extent permitted by law.  The responsibility for the safe use of our products and services rests solely with the individual ordering the service (the "owner") and/or the end user, as determined by the owner. While our products and services are designed to help reduce the risk of accidents, falls, personal injury, and property damage, we cannot guarantee that such incidents will not occur. Accordingly, All Access Adaptations, LLC (dba The Safer Bath Company) assumes no liability for any injury, loss, or damage resulting from the use or misuse of our products or services.  We make no guarantees or claims regarding the degree to which risks will be reduced, as the effectiveness of our solutions depends on factors beyond our control—including the end user’s physical condition, behavior, and environment, all of which may change over time. It is the sole responsibility of the owner and/or end user to evaluate and use our products and services appropriately and to assume all associated risks.

• 8. Intellectual Property
  All content on the Site, including text, images, logos, and designs, is owned by The Safer Bath Company or its licensors and protected by copyright, trademark, and other intellectual property laws. You may not reproduce or use any content without prior written permission.

• 9. Privacy & Data
  Your use of personal information is governed by our Privacy Policy that is available to view by clicking 'Privacy Policy' at the bottom of this page. By agreeing to these Terms, you also accept our Privacy Policy.

• 10. Third-Party Links & Services
  Our Site may contain links to third-party websites or services (e.g., Facebook, Google Analytics). We do not endorse or control these sites and are not responsible for their content or practices.

• 11. Governing Law
  These Terms are governed by and construed in accordance with the laws of the State of Arkansas, without regard to conflict of laws principles. Any dispute must be resolved in a state or federal court located in Logan County, Arkansas.

• 12. Changes to Terms
  We may update these Terms at any time. Changes will be posted with a revised "Effective Date". Continued use of the Site or Services after changes constitutes acceptance.
